Democrats’ Big Beautiful Opportunity In 2026?

May 20, 2025 By John DeProspo Leave a Comment

Some have called it “political suicide.” But could it be something else?

The House Republicans’ so-called “big beautiful bill” has stunned political observers — not because of its audacity, but because of its self-destructiveness. By some estimates, 14 million Americans could lose their health insurance under the proposed legislation. Many of them are Republican voters. And all of this in service of funding tax cuts for the ultra-wealthy.

So why would the GOP willingly inflict harm on its own base in the run-up to the 2026 midterm elections?

At first glance, it makes no sense. Midterm elections are historically brutal for the party in power — especially when they’ve passed wildly unpopular legislation. No rational party would alienate millions of supporters just before a major election.

Unless… they’re not planning to compete in a free and fair election at all.

That possibility recently came to mind after remembering a troubling remark Donald Trump made in the summer of 2024 at the Turning Point Action Believers’ Summit in Florida. Speaking to a crowd of supporters, he said:

“Get out and vote just this time. You won’t have to do it anymore. Four more years it will be fixed. It’ll be fine. You won’t have to vote anymore, my beautiful Christians.”

Many dismissed it as a joke. But as Rep. Dan Goldman (D-N.Y.) pointed out, “The only way ‘you won’t have to vote anymore’ is if Donald Trump becomes a dictator.”

And if we’ve learned anything from Trump’s time in office, it’s this: he often means the most extreme things he says — no matter how unlawful or absurd they sound.

So how might he try to make voting “a thing of the past”?

Simple: create chaos, then exploit it. If protests erupt over economic turmoil, unpopular laws, or international crises, Trump could declare a national emergency — and use it as a pretext to postpone or cancel the 2026 midterms. It would be unconstitutional, of course. But since when has the Constitution stopped him?

What about the Supreme Court, you ask? Historically, the Court has defended democratic norms. But with its current makeup, and given its recent decisions, it’s not clear how it would rule in a constitutional crisis triggered by a president it helped empower.

So, is the GOP truly engaging in political suicide? Or is it betting on a future in which elections are either permanently skewed in its favor — or eliminated altogether?

It’s a disturbing thought, but one that must be faced: the 2024 election may prove to be the last free and fair national vote the United States sees for some time.

Could Trump Cancel 2020 Elections?

March 12, 2020 By John DeProspo 3 Comments

As the coronavirus outbreak worsens, could the 2020 elections be at risk? Can they be cancelled just like the NCAA today scrubbed its basketball tournament?

What if Trump declares a state of emergency and orders that elections be postponed to a later date?

Not possible you say? Think again.

The truth is we are in uncharted territory.

While it’s nice to think our laws and institutions protect us from a dangerous president and that a lawless chief executive can only do so much without bumping up against the limits set by the Constitution and Congress (and enforced by the courts), that just might not be the case.

Did you know the moment the president declares a “national emergency”—a decision that is entirely within his discretion—more than 100 special provisions become available to him?

While many of those concessions are geared to reasonable responses to genuine emergencies, some appear dangerously suited to a president eager to amass or retain power.

As Elizabeth Goitein writes in The Atlantic, “This edifice of extraordinary powers has historically rested on the assumption that the president will act in the country’s best interest when using them. With a handful of noteworthy exceptions, this assumption has held up. But what if a president, backed into a corner and facing electoral defeat or impeachment, were to declare an emergency for the sake of holding on to power? In that scenario, our laws and institutions might not save us from a presidential power grab. They might be what takes us down.”

The coronavirus pandemic has the potential of turning into a catastrophe the likes of which our country, and the world, has never seen… and a golden opportunity for Trump to remain in power until he declares the “emergency” over.

I fear the odds of Trump taking such drastic action will only increase as his odds of winning reelection decrease.

If we’ve learned anything by now it’s that Trump … and his Republican enablers … have total disdain for our Constitution and the rule of law.

The scary part is that, historically, the Supreme Court has often upheld declarations of “national emergency” or found ways to avoid reviewing them, at least while the crisis still remained.

Uncharted territory indeed!

Trump Makes It Hard On Conservative Supremes

February 16, 2019 By John DeProspo 4 Comments

Donald Trump is his own worst enemy. He made that clear, once again, during yesterday’s rambling, incoherent  “national emergency” Rose Garden speech.

Responding to questioning from a reporter, Trump actually admitted he didn’t “need to do this.” Instead of sticking to the script that what is happening on our southern border is a serious national security issue, Trump blurted out the truth.

This is reminiscent of Trump’s interview with NBC’s Lester Holt when he admitted he was going to fire FBI Director James Comey, because of that whole Russia thing, regardless of recommendations from his attorney general and deputy attorney general.

It seems the serial liar can’t help incriminating himself by occasionally letting out a truth bomb.

While Trump’s speech contained many of the usual lies about illegal immigration and the necessity of a border wall, he did get one thing straight … this whole national emergency charade will be decided by the courts.

“We will have a national emergency, and we will then be sued, and they will sue us in the 9th Circuit, even though it shouldn’t be there, and we will possibly get a bad ruling, and then we will get another bad ruling, and then we will end up in the Supreme Court,” said Trump.

While under normal circumstances one would expect the compliant conservative Supreme Court to go along with the President’s broad power to declare a national emergency, saying this is not really an emergency ain’t the way to go. It just might get a justice like John Roberts to say “no amigo.”

Roberts has now replaced former justice Anthony Kennedy as the swing vote on the Court. As Chief Justice, Roberts has his legacy to protect. He also has shown he cares about the independence of the Court.

No, Donald, even though you have packed the Court with two conservative lackeys (Gorsuch and Kavanaugh) don’t expect a rubber-stamp from the Supremes.

I am waiting for the day when Trump admits he did get help from Russia to win the 2016 presidential election, but it doesn’t matter because he would have won anyway!

The man is not very bright. He just can’t help himself.
